Indian Crystal & Gem Laboratory (ICGL) issues gemstone, crystal, and Rudraksha testing reports to its client(s) based on the acceptance of the terms and conditions mentioned below for obtaining laboratory testing and certification services rendered by ICGL.

At the time of submitting any gemstone, crystal, Rudraksha, jewellery, or article to ICGL for testing, the client agrees to comply with the terms and conditions of the laboratory. Any person to whom the testing report is transferred or presented shall also be bound by the same terms and conditions.

General

  1. Testing reports are issued at the request of the client. The issuance of a testing report does not imply that ICGL agrees to purchase, replace, or guarantee the gemstone, crystal, jewellery, or article submitted for testing.

  2. Testing reports issued by ICGL are not certificates of valuation, guarantee, appraisal, or legal ownership. The reports represent the professional opinion of the laboratory based on scientific examination.

  3. All testing reports are based on gemological analysis performed using available technology, instruments, and expertise at the time of examination.

  4. Goods submitted for testing remain the responsibility of the depositor. ICGL shall not be responsible for loss, theft, damage, or deterioration of the submitted article due to circumstances beyond its control.

  5. ICGL does not provide any opinion regarding the commercial value, market price, or ownership of the tested stone or article.

  6. Verification reports downloaded or printed from the ICGL website are provided for reference purposes only and may not be considered the original laboratory report.

  7. Testing reports may be transferable; however, ICGL is accountable only to the first client who submitted the article for testing as per laboratory records.

  8. ICGL reserves the right to declare any previously issued report void if the circumstances require or if discrepancies are discovered.

  9. Any claims or disputes regarding the testing report must be brought to the attention of ICGL within fifteen (15) days of issuance of the report.

  10. Clients agree to indemnify ICGL against claims made by third parties based on the interpretation or use of the laboratory report.

  11. ICGL may use anonymized testing data or images of gemstones for research, educational, or publication purposes.

  12. Any disputes arising from services provided by ICGL shall be governed by the laws of India and subject to the jurisdiction of the courts where the laboratory is located.

LIMITS OF ICGL LIABILITY

  1. Details mentioned in the testing reports are based on observations made during examination and ICGL does not warrant the future condition of the gemstone or article.

  2. The liability of ICGL, if any, shall be limited to the amount of fees paid by the client for the testing service.

  3. ICGL shall not be responsible for direct or indirect losses incurred by any person relying on the testing report.

  4. The depositor agrees to indemnify ICGL and its staff against any damage, claims, or costs arising from the testing process.

  5. ICGL does not guarantee the accuracy, completeness, or reliability of results beyond the scope of the scientific methods applied.

  6. ICGL or its employees shall not be liable for any loss caused due to human error, equipment limitations, or unforeseen technical issues during testing.

  7. ICGL is not liable for damage to fragile gemstones or jewellery that may have pre-existing cracks, inclusions, or structural weaknesses.

SUBMISSION AND DELIVERY OF ARTICLES

  1. Acceptance of stones or articles for testing is subject to the discretion of ICGL and the availability of laboratory equipment.

  2. Delivery timelines are estimated and may vary depending on workload, testing complexity, and technical factors.

  3. ICGL assumes that the depositor submitting the article is the rightful owner or authorized person.

  4. Test reports and submitted items may only be collected by the person who submitted them unless proper authorization is provided.

  5. Testing services are strictly against advance payment unless otherwise approved by the laboratory.

  6. Transportation, courier, or insurance charges for submitted items are not included in the testing fees.

  7. Clients must collect their stones and reports within three (3) months from the date of report issuance.

  8. If the submitted item is not claimed within the specified period, ICGL reserves the right to dispose of or return the item at its discretion.

TESTING

  1. No destructive testing shall be conducted without the prior consent of the client.

  2. ICGL does not undertake testing to determine the metal purity or karatage of jewellery unless specifically requested.

  3. Testing of mounted stones may be limited due to mounting restrictions.

  4. Testing reports are issued in a standardized laboratory format and cannot be altered according to client preference.

  5. All testing results are based on scientific examination using gemological instruments and accepted testing methods.

  6. Reverification may not always be possible for stones submitted in bulk or packet lots.

  7. Photographs included in the report represent the tested specimen but may vary due to lighting or printing limitations.

  8. Terminology used in reports may evolve with advancements in gemological research.

  9. ICGL reserves the right to update terminology or classification based on new scientific findings.

  10. The characteristics mentioned in the report are those identifiable within the laboratory’s defined testing parameters.

  11. Laser inscriptions or markings on gemstones may not always be recorded in the report.

TECHNICAL LIMITATIONS

  1. Testing reports reflect the condition of the stone at the time of examination.

  2. Alterations made to a gemstone after testing may invalidate the report.

  3. ICGL shall not be responsible for natural changes in gemstones over time.

  4. The origin or treatment of gemstones may not always be determinable.

  5. Results may vary across laboratories due to differences in instruments, testing methods, or interpretations.

  6. Certain gemstone treatments may remain undetectable using current technology.

  7. ICGL does not guarantee detection of all possible treatments.

  8. Variations in results may occur due to human interpretation or technical limitations.

  9. Determination of origin, treatment, or stability is not guaranteed due to evolving gemological knowledge.

  10. Reports become void if altered or if the gemstone is changed after testing.

  11. Accuracy of the report is based on technology and expertise available at the time of examination.

CANCELLATION

  1. Clients may cancel testing requests within two (2) hours of submission in writing or in person.

  2. If ICGL cancels a testing request, the applicable fees shall be refunded.

  3. Testing requests may be cancelled if the submitted article is unsuitable or contaminated for testing.

  4. Clients shall indemnify ICGL for any losses resulting from violation of these terms.

  5. ICGL reserves the right to modify these terms and conditions without prior notice.
